A Dutch municipality may hire a private firm to locate a property in Morocco and obtain an appraisal, with courts approving the process provided the data are accurate and verifiable, while a Moroccan company, ICOTEX, carries out the external valuation.

Netherlands: your assets in Morocco sought by private firms

A Dutch municipality has the power to commission a private company to locate a property in Morocco and obtain a valuation. The country's courts uphold this approach, provided that the information gathered is precise and verifiable.

In practice, the contractor uses the personal data of the couple concerned to query the Moroccan land registers. Once the dwelling is identified, a Moroccan company, ICOTEX, carries out an external valuation.

This court ruling confirms the existence of a mechanism allowing Dutch municipalities to search for assets held in Morocco via private operators. The framework is now in place for such cross‑border searches.

However, the rule is strict going forward. To withdraw a benefit or demand its repayment, the administration must provide concrete, verifiable evidence obtained in a proportionate manner.
